Insights into The Consumer Protection

Yayasan Pengguna Negara Malaysia (YPNM), Cawangan Miri Sarawak had the privilege to host the seminar on Insights into The Consumer Protection (Workshop Information Disclosure) (Amendment) Regulations 2022 with the collaboration from Kementerian Perdagangan Dalam Negeri dan Kos Sara Hidup, Sarawak (KPDN Sarawak) and Persatuan Industri Kecil Miri (PIKM).

This seminar was official by KPDN Officer YBrs Tuan Nor Azhari Bin Yusof (Timbalan Pendakwa Raya KPDN Sarawak) and accompanies by YBrs Tuan Ismail Bin Abdul Aziz (KPDN Sarawak), YBrs Tuan Joshua (KPDN Miri), YBrs. Tuan Chong Kong Ming (Chairman, YPNM Miri), YBrs. Tuan Jimmy Ling (Secretary, YPNM Sarawak), Tuan Leong Wee Ming (Deputy Chairman, YPNM Miri) and Tuan Chieng Lee Wei (Vice Chairman, YPNM Miri).

The Consumer Protection (Workshop Information Disclosure) (Amendment) Regulations 2022 was supposed to enforced last year 2022 but the Ministry decided to give one-year grace period for all workshop operators to come on board.

 

 

 

The enforcement of the amendment which was gazetted on 22nd June, 2022, after a series of engagements with industry players, had been postponed for a year from 1st July, 2022 to 1st July 2023, to allow those affected to prepare for the changes, said Tuan Ismail.

The Consumer Protection (Workshop Information Disclosure) (Amendment) Regulations 2022 not only encourages workshops to hire and upskill their mechanics, but also ensures consumers to have the access to qualified mechanics, thus this increases the quality of all the workshop service providers.

The penalty for not doing so, under the Consumer Protection Act 1999 (Act 599), is a RM100,000.00 fine for companies and a RM50,000.00 fine for individuals, or a three-year jail term, if found guilty, said Tuan Ismail.

 

     

 

Under the ruling, workshops are required to display the names and qualifications of the mechanics employed, clearly state whether spare parts offered are new, used, or rebuild, provide a written document on whether there is any guarantee for the said spare parts, and state whether there is a guarantee period for the repair’s jobs carried out by the workshop.

Employers should be aware and make plans to accommodate these incoming changes to the Malaysian workplace.
